If you believe that any content, book preview, text, image, or graphic hosted on bookstair.com infringes upon your copyright, you may submit a request to have the material removed or disabled by providing our designated Copyright Agent with a written takedown notice containing the information detailed below.


Section 1

Submitting a DMCA Takedown Notice

To file a valid copyright infringement notice with Ocxly Publishing House, you must provide a written communication (via email or physical mail) that includes all the following information:

  1. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed (for example, the title of the book, registration number if applicable, or a link to the original work).
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit us to locate the material. You must provide the exact URLs on bookstair.com where the alleged infringing material is located.
  4. Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, physical address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a "good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  6. Perjury Statement: A statement that the "information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Upon receipt of a valid and complete DMCA notice, Ocxly Publishing House will remove or disable access to the allegedly infringing content, and make a good-faith attempt to notify the uploader or author of the material regarding the removal.


Section 3

Counter-Notification Procedure

If your material was removed or disabled as a result of a DMCA takedown notice, and you believe that the material is not infringing, or that you have the authorization from the copyright owner, the owner's agent, or pursuant to the law, to post and use that material, you may send a written Counter-Notification to our Copyright Agent.

Your Counter-Notification must contain the following statutory details:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location (URLs) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a "good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you reside outside the United States, that you consent to the jurisdiction of the Federal District Court for the Western District of Texas), and that you will accept service of process from the person who provided the original DMCA notification or their agent.

If our Copyright Agent receives a valid Counter-Notification, we will send a copy of it to the original complaining party informing them that we may restore the removed material in 10 to 14 business days, unless the copyright owner files an action seeking a court order against the uploader.

Repeat Infringer Policy

In accordance with the DMCA and other applicable intellectual property laws, Ocxly Publishing House maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the access of users, authors, or contributors who are deemed to be repeat infringers. We also reserve the right to restrict access to the website or terminate the publishing and affiliate agreements of any party who repeatedly infringes the intellectual property rights of others, with or without notice.
